Florida cannabis business compliance guide

Market Type

In Florida, cannabis is regulated by the Office of Medical Marijuana Use (OMMU). Only medical cannabis is allowed. 

Tracking and Inventory

Florida uses Biotrack for their state seed-to-sale tracking system. MMUR is used for patient allotments; however, this data is passed through Biotrack.

Purchase Limits

Medical

  • Purchase limits are by prescription - 45 day supply maximum.
  • Maximum Possession Limit is 4 Oz.

Taxes

Adult-use

No cannabis specific taxes.

Delivery

Delivery may only be conducted for patients and caregivers.  There is no delivery ruleset specifically, but it is permitted by statute.

Menu Approval Required

According to an Emergency rule, effective 8/9/22, Florida requires Dispensary Websites to be approved by the State prior to going online.
